FN Analytica - Terms of Service

1. Who we are

FN Analytica ("the Service", "we", "us", "our") is a market-intelligence and island-analytics platform for Fortnite UEFN/Creative creators, operated by 4reel Pty Ltd (ACN 646 628 159, ABN 13 646 628 159), trading as Lettuceplay, based in New South Wales, Australia.

FN Analytica is not affiliated with, endorsed by, or sponsored by Epic Games, Inc. Fortnite, UEFN, and related marks are trademarks of Epic Games. Our analytics are derived from publicly available platform information and data you provide; Epic has no responsibility for this Service.

2. Acceptance and eligibility

By ticking "I agree" at signup or checkout, creating an account, or using the Service, you agree to these Terms and to our Privacy Policy. We record the version you accepted, the date/time, and your user ID.

Eligibility:

• ·You must be 18 or over to own an account or purchase a subscription.
• ·16-17 year olds may use the free Service only with a parent or guardian's consent (for example, when assisting a studio).
• ·The Service is not for anyone under 16.
• ·You must be able to form a binding contract and be using the Service for your own creator, studio, or business purposes.

3. Accounts

• ·You are responsible for your account credentials and everything done under your account. Sign-in is via email/password or third-party OAuth (Google, Discord).
• ·Provide accurate information. One account per person; do not share accounts.
• ·We may suspend or terminate accounts that violate these Terms (see section 12).

4. Plans, billing and trials

• ·Free tier: general platform information at no charge.
• ·7-day Pro trial: new users get a 7-day Pro trial. No payment method is required. The trial does not automatically convert to a paid subscription; at the end of the 7 days your account returns to Free unless you choose to subscribe.
• ·Pro subscription: paid intelligence features, billed monthly or yearly in advance via Stripe at the prices shown at checkout (prices in USD unless stated). Founding-member pricing is honoured for as long as the qualifying subscription remains continuously active.
• ·Automatic renewal (shown at checkout): paid subscriptions renew automatically. Before you pay, checkout discloses the price, the billing frequency (monthly or yearly), the renewal date, and how to cancel. You can cancel any time from your account; access continues to the end of the paid period.
• ·Taxes and currency: prices are exclusive of taxes unless stated; any GST or other taxes are added as required. If you pay in a currency other than USD, your bank or card provider sets the conversion rate and may add fees; those are outside our control.
• ·Failed payments: if a renewal payment fails, we may retry and will notify you; Pro access may be paused until payment succeeds, after which the account continues on Free.
• ·Refunds: we do not provide refunds for change of mind (the free trial lets you evaluate Pro before paying), and annual plans are not refunded pro-rata on cancellation (access continues to the end of the paid period). Nothing here limits your rights under the Australian Consumer Law, which we always honour; we will also provide a refund where the law requires or where a genuine fault on our side warrants it.
• ·Price changes: we will give at least 30 days' notice before a price change takes effect at your next renewal; you may cancel before it applies.
• ·Client/agency engagements (managed portals, retainers, deliverables) are governed by their separate engagement agreement; these Terms apply to platform access itself where not overridden.

5. The data and what it is (important)

• ·Analytics are estimates derived from observed public platform data and data you upload. Epic does not expose complete data; numbers may be delayed, incomplete, or revised, and Discover-surface behaviour can change without notice. We do not guarantee accuracy, completeness, or fitness for a particular decision.
• ·No financial, investment, or professional advice. Metrics, scores, benchmarks, opportunity ratings, and similar outputs are informational only. Decisions about building, buying, selling, or investing in islands or related assets are yours alone.
• ·Your uploaded data: you may upload your own Creator Portal exports for verified analytics. You warrant you are entitled to upload them. You retain ownership; you grant us the licence in section 7 to process them.

6. Acceptable use

Do not: (a) scrape, bulk-export, resell, or redistribute Service data or derived datasets beyond the built-in sharing tools and the permitted use below; (b) share Pro content or credentials outside your account; (c) probe, overload, or circumvent security, rate limits, or the paywall; (d) upload data you do not have rights to, or malicious content; (e) use the Service to violate law or third-party terms (including Epic's); (f) train machine- learning models on Service data without written permission. We may rate-limit or block abusive usage.

Permitted sharing: you may use the Service's built-in sharing features (such as win cards and share links), export your own island data (including CSV of data you uploaded or that concerns your own islands), and publish screenshots or short extracts of the Service with attribution to FN Analytica. This permitted use overrides the general redistribution restriction in (a).

7. Intellectual property and licences

• ·The Service (software, design, metrics definitions, reports, and derived datasets) is owned by 4reel Pty Ltd (trading as Lettuceplay) or its licensors. We grant you a limited, non-exclusive, non-transferable licence to use it for your own creator/business purposes while your account is in good standing.
• ·Your content: you retain rights to data you upload. You grant us a worldwide, royalty-free licence to host and process it to provide, improve and commercialise our products and services, including reports and analyses prepared for third parties, in aggregated or de-identified form that does not identify you or your islands.
• ·Win cards: when the Service detects a significant improvement ("breakout") on an island you have verified as yours, we may automatically generate a branded image (a "win card") featuring your island's name and code, your creator name, and the public metrics behind the breakout. You grant us a worldwide, royalty-free licence to create, store, display and use win cards, including in our marketing and social media, as evidence of creator outcomes on the Service. Win cards only ever contain information already publicly visible on the Service. If you use the share feature, the card appears on a public page on our site. You may request takedown of a specific win card, or opt out of win-card marketing, at any time (Privacy Policy section 3B).
• ·Feedback you send us may be used without obligation.

8. Third-party services

The Service depends on third-party providers (hosting, payments, email, authentication, and the Anthropic API for aggregate weekly commentary). Their availability is outside our control. Payment card data is handled by Stripe; we never store card numbers.

9. Availability and changes

The Service is provided "as is" and evolves quickly; features may change, be paused, or be removed. We aim for high availability but do not guarantee uninterrupted service. We may run maintenance windows.

10. Disclaimers and liability

To the maximum extent permitted by law, and without excluding rights under the Australian Consumer Law (ACL) that cannot be excluded:

• ·We disclaim implied warranties; the Service and all data are provided without guarantee.
• ·Our total aggregate liability for any claim is limited to the greater of (a) amounts you paid us in the 12 months before the claim, or (b) AUD $100. We are not liable for indirect or consequential loss, lost profits, or lost data.
• ·Where the ACL applies and liability for a consumer guarantee cannot be excluded, our liability is limited (at our option) to re-supplying the service or paying the cost of re-supply, to the extent the ACL permits.

11. Indemnity

You indemnify us against third-party claims to the extent they arise from (a) your unlawful or infringing content, (b) your wilful misconduct, or (c) your material breach of these Terms. This indemnity does not apply to any loss caused by our own negligence, our breach of these Terms, or a security failure on our side.

12. Suspension and termination

• ·Ordinary breach: we will give you notice and a reasonable opportunity to fix the problem before suspending or terminating for an ordinary breach.
• ·Immediate suspension: we may suspend immediately, without prior notice, for security risks, fraud, non-payment, or where required by law.
• ·Discontinuation: if we discontinue the Service, we will give reasonable notice and refund unused prepaid periods pro-rata.
• ·If we terminate without fault on your part, we refund unused prepaid periods pro-rata.
• ·Your data on termination: for a reasonable period before deletion, you can export your uploaded data; after that, uploaded content is deleted or de-identified per the Privacy Policy. You may close your account at any time.
• ·Sections that by nature survive (IP, disclaimers, liability, indemnity) survive termination.

13. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia; the courts of NSW have non-exclusive jurisdiction. Before starting proceedings, you agree to first raise the dispute with us in writing (section 15) and negotiate in good faith for 30 days. Nothing in this section restricts your mandatory consumer remedies, your right to approach a tribunal or regulator, or urgent injunctive relief.

14. Changes to these Terms

We may update these Terms; material changes get at least 14 days' notice by email or in-app, with the new version and effective date. For changes that materially affect your rights, we will ask you to accept the updated Terms before you continue to use the affected features, rather than relying on continued use alone.
